This Agreement is made this ___ day of _____________, 200__, between Great Pyrenees Rescue of Oklahoma (hereinafter referred to as GPR and _______________________________________________(hereinafter referred to as Adopting Party).

In consideration of the terms outlined in this Adoption Contract, GPR hereby agreed to adopt out one Great Pyrenees dog from rescue described as follows:

The cost of the adoption will be the minimum sum of $__________ as a donation to the Great Pyrenees Rescue of Oklahoma to help off-set incurred veterinary expenses and the care of the Great Pyrenees dog while in rescue.

TERMS OF ADOPTION

I.   Adopting Party(s) Responsibilities

   A.  Adopting Party may not transfer custody of the dog to anyone other than GPR and agrees to return the dog to GPR if     they  are ever unable to keep the dog.  Adopting party further agrees:

  1. To never abandon the dog or surrender, sell, or give the dog to a shelter, pet dealer or a laboratory;

  2. To never allow the dog to be beaten, neglected, treated cruelly or otherwise abused;

  3. To never allow the dog to be the subject of, or subjected to, any biological, chemical, psychological, or other experiment;

  4. To never give, lease, or otherwise transfer custody of the dog to any other person, or to any business or organization except to return the dog to GPR;

  5. If the dog is lost or stolen the Adopting Party agrees to notify GPR immediately.

B.   Adopting Party agrees to notify GPR promptly of any change of address, or phone, and to keep GPR informed about the health and well being of the dog. 

C.   Adopting Party agrees to exercise normal care in maintaining the health of this Great Pyrenees. This includes but is not limited to:

  1. Adopting Party will not  remove the Double Dew Claws on the rear feet of the dog;

  2. Adopting Party will provide fresh food, fresh water, and adequate daily exercise;

  3. Adopting Party will maintain this large breed dog on a proper diet at a weight sensible for its size and age (see Recommended Weight above.)

  4. Adopting Party will provide, and if requested, provide proof to the GPR, of routine preventative care which includes:

  •           a.  Annual physical examinations by a licensed veterinarian;

  •           b.  Three year vaccination against DHLPP and Rabies;

  •           c.   Routine fecal examinations and annual heartworm screenings and flea and tick control as needed;

          d.  Provide monthly Heartworm preventative. 

    5.  Adopting Party agrees:

  •            a.  To always keep this dog untethered within a secure fence unless being walked on leash;

  •            b.  To prevent escape by providing adequate inspection and maintenance of fencing and supervision of dog     within the fencing;

  •            c.  At  no time will the dog be allowed off leash in an unfenced area.

   6.   Adopting Party will groom or trim the coat to prevent matting, keep nails and dew claws trimmed and provide proper  care for the ears and teeth.

D.  Adopting Party agrees to provide vet care for health problems that may arise or injuries that may occur.

E.   Adopting Party agrees to never allow this dog to be trained as, or used as, an attack dog and to never allow this dog to be used in any aspect of dog/animal fighting.

F.   Adopting Party agrees to have personal identification (personal I.D. tag and License tags on said dog at all times; to regularly check the tightness of any collar, and to never leave a choke collar on the dog when unattended.

G.   Adopting Party agrees to and is aware that the dog is micro-chipped, registered to and will remain registered to Great Pyrenees Rescue of Oklahoma. 

H.   Adopting Party agrees to always transport this dog in a safe manner and never loose in an open topped vehicle of the open bed of a truck.

II.  GPR Responsibilities and Guarantees

   A.  GPR agrees to provide a history (as much as is available) and medical records on the dog including inoculations, vaccinations, worming and other medical care that was given. 

   B.  GPR is not responsible for the death, injury, or deformity of the dog due to accident, illness, or any deviation from adequate care normally given a large breed dog, including obesity. 

III.    Additional Terms of Adoption (to be initialed by Adopting Party)

    A.   The typical characteristics and temperament of the Great Pyrenees have been explained to me/us. Initials____

    B.  I/we have been advised that this dog may have been neglected, mistreated or abused and that special care or precautions may be required.  Initials: ____   

    C.  I/we have researched this breed thoroughly and the decision to adopt a Great Pyrenees has been agreed upon by all immediate household members.  Initials: _______

It is agreed that if the Adopting Party fails to perform any of those acts which he/she has guaranteed to perform, that the GPR may, at its option, revoke this Agreement and retake possession of the dog with the Adopting Party forfeiting further right to the dog.

Adopting Party(s) agrees to hold harmless and release GPR and/or its members, volunteers and other individuals working for and/or assisting with rescue from all liability, claims, and/or causes of action arising from any acts, injury and/or occurrences engaged in and/or caused by the dog subject to this agreement, as well as indemnification for damages, court costs, and/or attorney's fees incurred  by the GPR and/or its members for any court proceedings relating to such matters.  Jurisdiction lies in the County of Residence, in which below signed GPR is located.

Adopting Party(s) agrees to indemnify and hold harmless GPR and/or its members for any costs, attorney's fees or other disbursements incurred in enforcing the terms of this Agreement against the undersigned Adopting Party(s) in the event the undersigned Adopting Party(s) violate the same.

Any changes or additional terms to this Agreement must be in the form of an Addendum and signed by all parties.

THE UNDERSIGNED ADOPTING PARTY(S) HAVE READ THE FOREGOING ADOPTION AGREEMENT AND HOLD HARMLESS RELEASE AGREEMENT AND FULLY UNDERSTAND THE SAME AND AGREE TO BE BOUND TO ITS PROVISIONS.
